Terms of Service

1. What these terms cover

pragma.vision is a technology-observatory service: a public technology register and atlas, published articles and digests, the paid Professional Watch subscription, the ebook shop, and the free Art. 50 Quick Scan. Accounts are provided through my.soft.house (its Terms of Service apply to the account itself).

2. Free content

Browsing the register, atlas, articles and digests is free and requires no account. Content is provided for general information — it is not investment, legal or professional advice, and decisions based on it are your own.

3. AI-assisted content

Parts of the published content are AI-assembled from our curated data and are labeled as such on the page (our transparency approach under EU AI Act art. 50). Human-editorial sections are labeled accordingly. If you believe a page is mislabeled, tell us and we will review it.

4. Accounts and acceptable use

Sign-in uses your my.soft.house account. You may not scrape at volumes that degrade the service, republish our register or content wholesale, probe security, or use the service unlawfully. API/agent access, where offered, has its own published limits.

5. Professional Watch subscription

• Price and billing period are shown at purchase; billing is handled by our payment provider. You can cancel any time from the customer portal — cancellation stops future renewals and access continues to the end of the paid period.
• EU consumers: you may withdraw within 14 days of starting your subscription (the first purchase, not automatic renewals) and receive a full refund to your original payment method. Send your withdrawal notice through the Opinion form, the link in your order email, or any other clear statement (Refund Policy §4).
• We may change subscription pricing with at least 30 days notice; changes apply from your next billing period, and you can cancel before they take effect.

6. Ebook shop

• Checkout, VAT and invoicing for ebooks are handled by Lemon Squeezy as Merchant of Record. Lemon Squeezy's checkout terms apply to the payment transaction; these terms govern the content license.
• License: personal, non-exclusive, non-transferable. You may read the files on your own devices and keep private backups. You may not resell, republish, redistribute, or use the content to train AI systems for redistribution. Files are DRM-free — we rely on this license and your good faith.
• EU consumers — digital content: you may withdraw from an ebook purchase within 14 days of buying it, even after downloading, and receive a full refund to your original payment method. Ask through the Opinion form or the link in your order email (Refund Policy §4).

7. Intellectual property

The register, atlas, articles, ebooks and branding are owned by Pragma Vision LLC or licensed to us. Short quotation with attribution and linking are welcome; wholesale reproduction is not.

8. Liability

Nothing here excludes liability that cannot be excluded by law, including EU consumer rights. Otherwise our liability is limited to the amounts you paid us in the 12 months before the claim; we are not liable for decisions made in reliance on observatory content (§2).

9. Refunds and withdrawal

The standalone Refund Policy restates the cancellation, withdrawal and refund rules of §5 and §6 in one place. If the two ever disagree, these Terms prevail.

10. Changes to these terms

Material changes: 14 days advance notice to subscribers by e-mail and renewed acceptance at next sign-in; the version and effective date appear at the top of this page, and your acceptance is recorded with the version number.

11. Governing law

Law of the State of Wyoming, USA, without depriving consumers of mandatory protections of their country of habitual residence, including the right to proceed in their own courts.

12. Language versions

These terms are available in Polish and English. For purchases made in Polish or by consumers habitually resident in Poland, the Polish version prevails; otherwise the English version prevails.

13. Art. 50 Quick Scan

• What it is. The Quick Scan is a free tool. It observes the publicly reachable pages of a website you name (the home page and up to 5 more pages of the same site, within a 45-second time limit) and reports what it saw against the method published at pragma.vision/art50/method. A result records what the scanner observed at that moment. It is not a legal opinion, an audit, a finding that a site meets or breaks the law, or a certification, and it never says a site is compliant.
• Fair use. You may scan any public website, including sites of others that you are assessing. You may not: use the Quick Scan or its results to harass, threaten or pressure anyone, including by threatening to publish or report a result, or offering to withhold or remove it, in return for payment or any other benefit; present a result as a certificate, approval or seal; try to get around the browser check, the rate limits or other abuse controls; or submit addresses whose path or query contains passwords, secret tokens, session identifiers or non-public personal data. Scans are rate-limited (currently 5 per requester per 24 hours), and we may further limit or pause scanning for security, abuse-prevention, capacity, maintenance or legal reasons.
• How the scanner behaves. The scanner identifies itself as PragmaVisionArt50 and honours robots.txt. It does not log in, submit forms, send chat messages or click to accept tracking; it only loads pages, opens chat widgets, and tries to reject or close known consent dialogs. A site owner can block it with User-agent: PragmaVisionArt50 and Disallow: / in robots.txt.
• Results. A result is reachable through an unguessable link and is deleted 30 days after the scan. Anyone you share the link with can read it until then. A result can be incomplete: some pages, widgets or media may not be measurable, and the result says so.
• Agents. Where we offer it, AI agents can request scans through our MCP server with an authenticated session. The same rules and limits apply.
