Art. 50 observation method
We describe only what can be observed on a public page at capture time. Read each finding together with the limits of its check.

Nine checks
| Check | Paragraph | What we observe | How and when | Verdict states | Limits |
|---|---|---|---|---|---|
A50-0.1 | informational | Presence of a page describing AI use. | Page address and visible text indicate an AI notice. A link alone does not establish its content. |
| |
A50-1.1 | 50(1) | AI interaction disclosure at first contact. | Widget signature and PL/EN/DE lexicon in the first message, header or adjacent label. No disclosure: gap; unopened widget: needs_confirmation; no widget: not_observed. |
| |
A50-1.2 | 50(5) | Textual, accessible widget disclosure. | For the 1.1 disclosure, inspect actual text and assistive-technology reachability. No disclosure: not_observed; unopened widget: needs_confirmation. |
| |
A50-2.1 | 50(2) | Machine-readable marking on AI-indicated media. | AI hints in the URL, description or metadata plus IPTC DigitalSourceType or C2PA presence. Unmarked: gap; no AI indication: not_observed. |
| |
A50-2.2 | 50(2) | Marking within the generative-system provider tooling. | Always needs_confirmation, including unavailable pages; absence of observation does not establish absence of marking. |
| |
A50-3.1 | 50(3) | Deployer notice for emotion recognition or biometric categorisation. | SDK signature and visible notice: observed; SDK alone: needs_confirmation; no signature: not_observed. |
| |
A50-4.1 | 50(4) | Label at AI-indicated media, potentially including deepfakes. | Inspect alt, caption, accessible name, title, nearby text and label placement. At content: observed; absent: gap; no AI hint: not_observed. |
| |
A50-4.2 | 50(4) | AI-assisted-text statement or editorial-responsibility contact. | A visible statement or editorial contact: needs_confirmation; neither: not_observed. Informational only. |
| |
A50-5.1 | 50(5) | Disclosure at the first exposure to content. | Footer-only or policy-only label: gap; at content: observed; unknown placement: needs_confirmation; no AI surface: not_observed. |

Reading the states
observed- The specified signal was observed. This state does not determine legal obligations.
gap- A signal expected by this check was absent. Review the cited surface and fix template.
needs_confirmation- External observation is insufficient; confirmation from the provider or deployer is needed.
not_observed- The surface or signal covered by the check was not found in the captured sample.
unmeasurable- A fetch, render or parse error prevented measurement. This is not evidence that a signal is absent.
Scanner identity and conduct
PragmaVisionArt50/1 (+https://pragma.vision/art50/method#scanner)
For unverified scans we honour robots.txt for PragmaVisionArt50 or *. Disallow stops rendering.
To disallow the scanner, add this rule to robots.txt:
User-agent: PragmaVisionArt50
Disallow: / Quick Scan: up to 6 same-origin pages, 45 seconds and 20 media objects, up to 5 MB each. No form submission, login, chat messages or tracking acceptance. Only widget opening and reject/close actions on known consent dialogs. We retain digests and minimal excerpts, without full page copies; results expire after 30 days.
Market observation
We periodically check the homepages of popular Polish websites with the same method. We visit the homepage only, always honour robots.txt (the rule above also opts a site out of this observation), open a chat widget without sending a message, and never submit forms. We publish aggregate statistics only: never the names of websites or tool vendors. A chat-tool vendor may receive from us, by post, a summary covering only its own deployments. Records about individual websites are deleted after 90 days.
